What Is California Proposition 65?

California Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires businesses to provide a clear and reasonable warning before knowingly and intentionally exposing individuals in California to certain chemicals identified by the state as causing cancer, birth defects, or other reproductive harm.

California maintains and periodically updates the Proposition 65 list. It includes naturally occurring and synthetic chemicals that may be present in foods, dietary supplements, household products, workplaces, and the environment.

Proposition 65 is a right-to-know law intended to help individuals make informed decisions about potential chemical exposures.

Why Might a Nudora Product Carry a Proposition 65 Warning?

Some ingredients used in dietary supplements come from natural sources, including plants, herbs, roots, minerals, and other botanicals. Because these materials originate in soil and the environment, they may contain trace amounts of naturally occurring substances such as lead or cadmium.

These substances are not intentionally added to Nudora products. However, depending on the product, serving size, frequency of use, and anticipated exposure, even trace amounts may require a Proposition 65 warning.

When Nudora determines that a warning is appropriate or legally required, we provide the applicable warning to comply with California law and give consumers information about potential exposure.

What Does a Proposition 65 Warning Mean?

A Proposition 65 warning does not necessarily mean that a product violates federal or other applicable safety standards. It means that the business providing the warning is aware or believes that use of the product may expose an individual in California to one or more chemicals on the Proposition 65 list at a level requiring a warning.

California has established safe-harbor exposure levels for many listed chemicals. These include:

  • No Significant Risk Levels, which apply to certain cancer-causing chemicals

  • Maximum Allowable Dose Levels, which apply to certain chemicals associated with reproductive toxicity

The standards and methods used to determine whether a warning is required may differ from standards applied by federal agencies and other jurisdictions.

The presence of a warning should not be interpreted as a determination by Nudora or a government agency that the product is unsafe. Consumers should consider the warning when deciding whether and how to use the product.

Nudora’s Quality Standards

Our products are manufactured in facilities that are registered with the U.S. Food and Drug Administration and follow applicable current Good Manufacturing Practices. FDA facility registration does not mean that FDA has approved a facility or its products.

Depending on the product and applicable specifications, quality testing may include:

  • Identity

  • Potency

  • Heavy metals, including lead, arsenic, cadmium, and mercury

  • Microbial contaminants

  • Pesticides

  • Residual solvents

A product may satisfy applicable federal requirements and Nudora’s quality specifications while still requiring a Proposition 65 warning based on California’s exposure standards.

Does Proposition 65 Apply Outside California?

Proposition 65 requires warnings for covered exposures occurring in California. California law does not require Proposition 65 warnings for exposures that occur entirely outside the state.

However, some businesses place the same warning on products distributed in multiple states or countries. As a result, consumers outside California may also see Proposition 65 warnings.

The specific warning applicable to a product, if any, will be displayed on the product page, product packaging, label, or at another legally appropriate location.

A warning may state:

WARNING: Consuming this product can expose you to chemicals, including [name of listed chemical], which is known to the State of California to cause cancer and/or birth defects or other reproductive harm. For more information, visit www.P65Warnings.ca.gov.

The wording of the warning may vary depending on the chemical, type of exposure, product, and applicable California regulations.
